These terms govern your use of JobCatch, operated by Missedcall Technologies Limited. By subscribing, you agree to these terms in full. Please read them carefully.

1. The Service

JobCatch provides an automated WhatsApp lead capture service for UK-based self-employed tradespeople and small businesses. The service includes AI-powered auto-replies, missed call SMS redirection, photo capture, lead summaries and a lead management dashboard.

JobCatch is designed for legitimate business use only. You may not use the service for personal use, resale, or any unlawful purpose.

The service connects to WhatsApp via approved third-party providers. JobCatch is not affiliated with or endorsed by WhatsApp or Meta.

2. Subscription & Billing

Subscriptions are billed monthly on a rolling basis. Prices are as shown on the pricing page at the time of subscription and may be subject to change with 30 days' notice.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.

Payments are processed securely via Stripe (web signups) or Apple's In-App Purchase system (iOS app signups). JobCatch does not store your card details.

Prices shown are exclusive of VAT where applicable.

3. Free Trial

New customers are entitled to one 7-day free trial per business. A valid payment method is required to start the trial. You will not be charged until the trial period ends.

If you cancel before the end of the trial period, no charge will be made. If you do not cancel, your subscription will automatically begin at the end of the trial at the applicable monthly rate.

4. WhatsApp & Messaging Compliance

You are responsible for ensuring your use of JobCatch complies with WhatsApp's Business Policy and Terms of Service. JobCatch is not liable for any account suspension, restriction or termination by WhatsApp or any third-party messaging provider.

You must not use the service to send spam, unsolicited messages, or any content that violates applicable laws or WhatsApp's policies.

5. Data & GDPR

JobCatch stores enquiry data (including customer names, phone numbers, job details and photos) on secure servers for the purpose of providing the service. Data is retained for the duration of your subscription and for a reasonable period thereafter.

As a user of JobCatch, you are the data controller for the personal data of your customers captured through the service. You are responsible for your own compliance with UK GDPR and the Data Protection Act 2018, including providing appropriate privacy notices to your customers.

Missedcall Technologies Limited acts as a data processor on your behalf. We will not sell or share your customers' data with third parties except as required to provide the service.

6. Acceptable Use

You agree not to use JobCatch to:

Missedcall Technologies Limited reserves the right to suspend or terminate your account immediately if these terms are breached, without refund.

7. Intellectual Property

All software, AI flows, content and technology underlying the JobCatch platform remain the intellectual property of Missedcall Technologies Limited.

Bespoke trade flows built by JobCatch for your account are licensed to you for use within the service and may not be extracted, copied or used outside of it.

8. Availability & Uptime

Missedcall Technologies Limited will use reasonable endeavours to maintain the availability of the service. However, we do not guarantee uninterrupted access and accept no liability for temporary outages, maintenance windows or third-party service disruptions.

No service level agreement (SLA) is provided on the free trial.

9. Limitation of Liability

To the maximum extent permitted by law, Missedcall Technologies Limited's total liability to you in connection with the service shall not exceed the subscription fees paid by you in the 30 days prior to the event giving rise to the claim.

We are not liable for any loss of revenue, loss of data, loss of business, or indirect or consequential losses arising from your use of the service.

10. Changes to the Service & Terms

Missedcall Technologies Limited reserves the right to modify, add or remove features from the service at any time. Where changes materially affect the service, we will provide at least 30 days' notice.

We may update these terms from time to time. Continued use of the service after changes are published constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
